Bismarck, N.D. — The Lignite Energy Council strongly supports the U.S. Environmental Protection Agency’s (EPA) proposed approval of North Dakota’s coal combustion residuals (CCR) permit program. If finalized, the decision would authorize the North Dakota Department of Environmental Quality (NDDEQ) to manage CCR in lieu of federal oversight, affirming the state’s capability to responsibly regulate coal ash while supporting continued energy production.
“North Dakota has long been recognized as a national model for coal mining and land reclamation,” said Jonathan Fortner, Interim President & CEO of the Lignite Energy Council. “This coal ash program builds on that legacy, demonstrating how thoughtful, state-led regulation can both protect the environment and support a strong energy industry.”
Coal combustion residuals, commonly known as coal ash, are byproducts of lignite-based electricity generation. Under NDDEQ oversight, these materials have been safely managed through decades of collaboration between state regulators and industry. If approved, North Dakota would become the fourth state in the nation to achieve this level of regulatory authority.
“North Dakota’s energy producers and environmental regulators have a proven track record of working together to manage materials responsibly,” Fortner added. “This program reflects that success and provides a strong foundation for continued innovation in coal ash recycling and reuse, delivering both economic and environmental benefits.”
The NDDEQ has been administered EPA-approved solid and hazardous waste programs for more than two decades, including tailored standards for coal ash disposal and beneficial use. The state has also led the way in promoting coal as reuse in construction and infrastructure projects—reducing landfill use and conserving natural resources. Coal ash was used in the construction of the Bismarck State College National Energy Cetner of Excellence building, and the North Dakota Heritage Center.
The Lignite Energy Council encourages stakeholders to participate in the public comment period and looks forward to continued collaboration with the NDDEQ to ensure responsible stewardship of coal combustion residuals.
